The case in question involves a young woman who alleges she was raped in 2018. Despite providing a detailed statement to the police, the case was never taken to court. The Attorney General’s office had maintained silence, offering no explanation for the inaction. Today, that silence was broken.
The Court of Appeal’s decision comes after the victim, supported by local NGOs, challenged the AG’s office. The NGOs, including Bay Leaf, have been at the forefront of advocating for victims of sexual violence in Malta. They argue that the AG’s office has a duty to act in the public interest and protect victims’ rights.
Reacting to the court’s decision, the victim, who wishes to remain anonymous, said, “Today, I feel heard. I feel like my voice, which was silenced for so long, has finally been acknowledged.”
A Step Towards Change
The court’s order is a significant step towards changing the narrative around sexual violence in Malta. It sends a clear message that silence is not consent, and that victims deserve justice.
Dr. Marie Claire Mifsud, a lawyer and activist for victims’ rights, welcomed the decision. “This is not just about one case,” she said. “It’s about sending a message that we will no longer tolerate silence in the face of sexual violence.”
The court’s order also comes at a time when Malta is under scrutiny from the Council of Europe’s GREVIO committee for its handling of violence against women. The committee has expressed concern about the low number of rape cases that reach court and the lack of support for victims.
