The ruling stated, “The respondent [AFM] was justified in concluding that the conduct of the complainant [Cpl X] was incompatible with the continuation of the employment relationship.”
Dr. Zammit further noted that the post had been made public, potentially damaging the AFM’s reputation and undermining the authority of its officers. The court also took into account the AFM’s code of conduct, which prohibits any action that could bring the force into disrepute.

Reacting to the ruling, an AFM spokesperson stated, “The Armed Forces of Malta takes pride in its discipline and respect for the chain of command. Cpl X, who had sought reinstatement and back pay, expressed disappointment with the ruling. However, he also acknowledged the gravity of his actions.
