The Court of Appeal has confirmed that rural pathways remain protected under our planning policy – PA92.
Understanding the PA92 Protection
The Planning Authority’s Policy Area 92 (PA92) is designed to protect and enhance rural areas, including their pathways. These routes, often centuries-old, are not just scenic; they’re vital for rural communities, walkers, and cyclists. The PA92 policy ensures that any development respects and maintains these pathways.
However, a recent planning application sought to build over a section of a rural pathway in the limits of Rabat. The Planning Authority rejected the application, citing PA92. The applicant appealed, arguing that the policy was unclear and that the pathway wasn’t well-defined. The Court of Appeal, however, upheld the Planning Authority’s decision, clarifying that rural pathways, even if not clearly defined on maps, are protected.
Victory for Rural Advocates
Environmental NGOs and local residents welcomed the ruling. “This is a victory for common sense and for Malta’s rural heritage,” said a spokesperson for Nature Trust – FEE Malta. “These pathways are part of our cultural scene, and they deserve protection.”
Local resident Maria Grech, who lives near the protected pathway, echoed these sentiments. “These paths are our lungs, our history, and our future. I’m glad the court agrees that they’re worth protecting.”
