Soldier’s Dismissal for Gate Mockery Upheld: Court Backs Army’s Decision

Imagine standing at the bustling Republic Street in Valletta, the capital’s main thoroughfare, and hearing the echo of a soldier’s laughter. That laughter, directed at the very institution he served, has now landed him out of a job, with the Industrial Tribunal ruling in favour of the Armed Forces of Malta (AFM).

Mocking the Gate, Mocking the Service

The soldier, identified only as ‘C’, was dismissed after a video surfaced online showing him mocking the AFM’s gate salute. In the clip, he can be seen mimicking the formal salute, laughing, and saying, “This is so stupid.” The video, recorded in 2019, resurfaced last year, sparking outrage and leading to his dismissal.

Court’s Verdict: Fair and Timely Dismissal

The Industrial Tribunal, presided over by Deputy Chairman Dr. Anthony Zammit, ruled that the AFM’s decision to dismiss ‘C’ was fair and timely. The court noted that the soldier’s actions were a breach of discipline and brought the AFM into disrepute. The ruling also highlighted military discipline and respect for the AFM’s code of conduct.

“The AFM’s code of conduct is not a mere piece of paper,” said Dr. Zammit. “It’s a reflection of the values and standards that the AFM expects its members to uphold.”

AFM: Maintaining Standards, Upholding Respect

Reacting to the ruling, the AFM stated, “We are committed to maintaining the highest standards of discipline and professionalism within our ranks. The decision to dismiss ‘C’ was not taken lightly, but it was necessary to uphold the respect and dignity of the AFM and its members.”

The AFM also took the opportunity to remind the public that such behaviour is not tolerated and that all members are expected to uphold the values and standards of the organisation.
