Army Gate Mockery: Soldier’s Dismissal Upheld, Court Rules in Favour of Military

Imagine standing at the bustling Republic Street in Valletta, the capital’s main thoroughfare, and witnessing a soldier, in full uniform, mocking the very institution he serves. This was the scene that played out last year, capturing the public’s attention and sparking a chain of events that culminated in a court ruling this week.

The soldier, identified only as ‘Cpl X’ in court documents, was caught on camera mimicking the opening and closing of the military gate at Fort St. Elmo, a historic fortress that stands sentinel over the Grand Harbour. The video, which quickly went viral, sparked outrage and led to the soldier’s dismissal from the Armed Forces of Malta (AFM).

Court Upholds Dismissal: ‘Fair and Timely’, Rules Judge

In a decision handed down this week, the Industrial Tribunal upheld the AFM’s decision to dismiss the soldier. The judge ruled that the soldier’s actions, captured on video and widely shared on social media, had brought the AFM into disrepute and undermined public trust in the military.

“The soldier’s actions were a breach of discipline and a violation of the AFM’s code of conduct,” the judge stated in the ruling. “The AFM’s decision to dismiss was fair and timely, given the gravity of the misconduct and the potential damage to the AFM’s reputation.”

Soldier’s Appeal: ‘Freedom of Expression’ vs. ‘Discipline and Respect’

The soldier had appealed his dismissal, arguing that his actions were protected under freedom of expression. However, the court ruled that while freedom of expression is a fundamental right, it is not absolute and must be balanced against other considerations, such as the need for discipline and respect within the military.

“The soldier’s actions were not a mere expression of personal opinion,” the judge noted. “They were a public mockery of the AFM and its traditions, carried out while in uniform and on duty. This is not protected by freedom of expression.”

The court also dismissed the soldier’s argument that he had been unfairly targeted, pointing out that the AFM had followed a fair and transparent disciplinary process.

AFM Welcomes Ruling: ‘Upholds Respect and Discipline’

Welcoming the court’s decision, an AFM spokesperson stated, “This ruling upholds the importance of respect, discipline, and professionalism within the Armed Forces. We expect all our personnel to conduct themselves in a manner that reflects these values, both on and off duty.”

The spokesperson also acknowledged the public’s role in bringing the incident to light, stating, “We appreciate the public’s vigilance and support in upholding the high standards expected of the AFM.”

As the AFM moves forward, it will be reviewing its training programmes to reinforce the importance of discipline, respect, and professional conduct. The AFM is also considering implementing stricter social media guidelines for its personnel, following a rise in incidents involving military personnel and social media platforms.

In the words of the AFM’s Chief of Staff, “We must learn from this incident and ensure that our personnel understand the gravity of their actions, both on and off duty. We must also engage with the public, fostering a culture of mutual respect and understanding.”
