Soldier’s Mockery of Army Gate Leads to Fair Dismissal, Court Rules

Imagine standing guard at the iconic Fort St. Elmo, Malta’s historic landmark, only to find your colleague mocking the very gate you’re sworn to protect. This was the reality for a Maltese soldier, whose actions have now resulted in a court ruling upholding his dismissal.

From Guard Duty to Viral Mockery

In an incident that sparked outrage and went viral on social media, a soldier was caught on camera mimicking the opening and closing of the gate at the Army’s Hal Far Barracks. The video, which surfaced in early 2021, showed the soldier jokingly pretending to operate the gate, a clear breach of military discipline and protocol.

The incident occurred at a time when the Armed Forces of Malta (AFM) were already under scrutiny for a series of misconduct cases. The mockery of the gate, a symbol of the AFM’s duty to protect Malta, was seen as a step too far by many.

Court Upholds Dismissal: Fair and Timely

A disciplinary board found the soldier guilty of conduct unbecoming of an officer and brought charges against him. After a lengthy process, the soldier was dismissed from the AFM. The case then moved to the Industrial Tribunal, where the soldier challenged his dismissal.

However, the court has now ruled that the soldier’s dismissal was ‘fair and timely’. In its decision, the court stated that the soldier’s actions had brought the AFM into disrepute and undermined public confidence in the military. The court also noted that the soldier’s actions were a breach of trust, given the sensitive nature of his role as a gatekeeper.

AFM: Zero Tolerance for Misconduct

Reacting to the court’s decision, an AFM spokesperson reiterated the military’s zero-tolerance policy towards misconduct. “The AFM expects the highest standards of conduct from its personnel. This ruling sends a clear message that such behavior will not be tolerated,” the spokesperson said.

The AFM has been working on improving its disciplinary procedures and enhancing training to ensure such incidents do not recur. The military has also been engaging with the public to rebuild trust and confidence in the AFM.

For the soldier, the ruling marks the end of a career in the AFM. For the military, it serves as a reminder that protecting Malta’s security is no laughing matter. As for the rest of us, it’s a stark reminder of the symbols and institutions that safeguard our nation.

In the words of a veteran soldier, “The gate at Hal Far is not just a gate. It’s a symbol of our duty to protect Malta. To mock it is to mock our very purpose.”
